Hamilton and Brewer LLC

You may return new, unopened items sold and fulfilled by Hamilton and Brewer within 10 days of delivery for a full refund. We'll also pay the return shipping costs if the return is a result of our error. Items must be returned in their original product packaging unless pre-approved by Hamilton and Brewer in writing. 

Any items (writing instruments and watches) that have been resized, damaged, or otherwise altered after delivery will not be accepted for return. All items must be returned in new, unworn condition, and will undergo quality checks. We charge a 10% restocking fee on any item that is special ordered by us and returned.

If you received a faulty item and need to exchange it for the same item, contact Customer Service to request a replacement. If you would like to exchange an item for a different one, please return the original item through our Returns Process (you will be refunded your original purchase price once we receive the item) and place another order for the item you wish to purchase. You do not have to wait for us to receive the original item before placing the new order.

We will process your refund after we receive and process your return. You can expect your refund within 2 weeks of sending your package back to us via your shipping method (though in many cases you will receive the refund sooner).

All items sold through Hamilton and Brewer LLC are covered under warranty (either by Hamilton and Brewer or by the specific manufacturer warranty). All warranties cover manufacturing defects only. The warranty does not cover damages such as scratches, finish, crystals, glass, straps (leather, fabric, rubber, etc.), damage due to wear and tear, damage resulting from wear under conditions exceeding the watch manufacturer's water resistance limitations and damage due to physical and/or accidental abuse. 

When the manufacturers warranty is included with an item (i.e, Oceanus, Pelikan, UZI, Namiki, Chase-Durer, Smith & Wesson, etc.), we will include the original authorized dealer endorsed warranty card.  And, although the consumer can send the watch directly back to the manufacturer for service if they choose, we encourage our customers to contact us & we will direct you on where to send the watch and how to go about getting the warranty service handled directly through the manufacturer. 

The Hamilton and Brewer warranty will cover all parts and labor or replace the item at our discretion within the warranty period of one year. Shipping and insurance costs for warranty returns to Hamilton and Brewer must be covered by the customer.  Returns must be shipped via traceable courier, e.g. UPS or USPS (Do not ship via FedEx, as FedEx does not insure watches or jewelry valued over $500).  Return shipments must be pre-paid and fully insured.  Collect shipping will be refused.  In case of loss or damages, customer is liable.

Typographical Errors
In the event that a Hamilton and Brewer LLC product is mistakenly listed at an incorrect price, Hamilton and Brewer LLC reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Hamilton and Brewer LLC reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Hamilton and Brewer LLC shall issue a credit to your credit card account in the amount of the incorrect price.


Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Hamilton and Brewer LLC without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Hamilton and Brewer LLC may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to Hamilton and Brewer LLC.


Miscellaneous
Your use of this site shall be governed in all respects by the laws of the state of California, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Hamilton and Brewer LLC products) shall be in the state or federal courts located in Los Angeles County, California. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Hamilton and Brewer LLC products) must be commenced within one (1) year after the claim or cause of action arises. Hamilton and Brewer LLC's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Hamilton and Brewer LLC may assign its rights and duties under this Agreement to any party at any time without notice to you.


Use of Site
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Hamilton and Brewer LLC or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited.
